1. Introduction and Acceptance
Welcome to garipova.com (the “Site”). The Site is owned and operated by Liliya Garipova, a sole proprietor based in Hamden, Connecticut, USA (“we,” “us,” “our”). These Terms and Conditions (“Terms”) govern your use of the Site and your purchase of any products offered for sale through the Site.
By accessing or using the Site, or by placing an order, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, please do not use the Site or place an order.
You must be at least 18 years of age, or the age of majority in your jurisdiction, to place an order. By placing an order, you represent and warrant that you meet this requirement.
2. About Our Artwork
We believe in being transparent about how the artwork sold on this Site is created.
2.1 AI-generated original artwork
All artworks sold on the Site are original digital compositions created by Liliya Garipova using generative AI tools. The artist directs each piece through original prompts, iterative refinement, curation, color and composition choices, and post-production work. Each artwork is a deliberate creative act, not a random output.
When you purchase a print, you are purchasing a reproduction of one of these original digital artworks on a physical medium (canvas).
2.2 Copyright status of AI-generated images
Under current United States Copyright Office policy (as of 2024), images generated primarily by generative AI tools are not eligible for copyright registration as standalone works, because copyright registration requires human authorship of the expressive elements. The artist’s creative direction, prompt design, selection, and arrangement may be protectable; the AI-generated images themselves, in isolation, are not.
We disclose this so that buyers understand the legal status of the underlying images. This disclosure is not a waiver of any rights the artist does have, including rights in the artist’s name, brand, edition numbering, and the curated selection and arrangement of works on this Site.
2.3 Reproduction medium
Prints are reproduced on museum-quality matte stretched canvas with a 1.25″ deep hardwood frame. Prints are made to order (see Section 5).
3. Products and Pricing
- We make commercially reasonable efforts to ensure that product descriptions, images, sizes, and prices on the Site are accurate. Despite our efforts, occasional errors may occur. We reserve the right to correct any errors and to refuse or cancel any order containing pricing or descriptive errors at any time before shipment, in which case we will refund any amount already charged.
- All prices are in United States Dollars (USD) and exclude any applicable sales tax, which will be calculated and added at checkout where required.
- We may add, remove, or modify products and prices at any time without prior notice. Changes will not affect orders already placed.
4. Orders and Payment
- When you place an order, you make an offer to purchase the selected product(s) at the listed price. Our acceptance of your offer occurs when we send a confirmation that your order has been processed for production. Until that point, we may decline or cancel an order for any reason.
- We currently accept payment via Stripe (credit and debit cards) and PayPal. Payment is captured at the time of order placement.
- You represent that any payment information you provide is accurate, that you are authorized to use the payment method, and that the funds are available.
- Sales tax will be added to orders shipped to addresses in jurisdictions where we are required to collect it (including Connecticut). The applicable tax will be displayed at checkout before payment.
5. Shipping and Delivery
5.1 Made to order
Each print is produced after your order is placed. We do not maintain physical inventory.
5.2 Fulfillment partner
Production and shipping are handled by our fulfillment partner, Printify, and Printify’s production partners. We do not handle physical production or carrier hand-off; we coordinate with Printify on your behalf and remain your primary point of contact for any issues.
5.3 Production and shipping windows
- Production typically takes 3 to 8 business days after order placement.
- Shipping typically takes an additional 3 to 5 business days within the United States, depending on the shipping address and carrier.
- These are estimates, not guarantees. Actual times may vary based on production capacity, carrier performance, weather events, and other factors outside our control.
5.4 Shipping destinations
We currently ship only to addresses within the fifty United States. We do not currently ship internationally or to U.S. territories. If we expand our shipping coverage, we will update this Section accordingly.
5.5 Shipping carriers and tracking
Shipping is handled by Printify’s carrier partners (which may include USPS, UPS, or regional carriers). When your order ships, you will receive a tracking number by email.
5.6 Risk of loss
Risk of loss and title for the product pass to you upon delivery to the carrier. If a package is lost in transit, see Section 7 for the claims process.
6. Color Reproduction and Display
Colors on a digital screen do not always match the colors of a printed canvas. Several factors contribute to this:
- Monitors, phones, and tablets vary in calibration, brightness, and color profile.
- Lighting in the room where the print is displayed affects perceived color.
- Canvas substrate and matte print finishes render color slightly differently than backlit screens.
Slight variation in color, saturation, and tone between the digital image and the physical print is a normal characteristic of canvas reproduction and is not considered a defect. If exact color matching is critical for your space, please contact us before ordering to discuss whether a sample is available.
7. Returns, Refunds, and Cancellations
7.1 Made-to-order means a defect-only return policy
Because each print is produced specifically for your order, we cannot accept returns for change of mind, color preference, or fit. Returns and refunds are limited to defective or damaged items, as described below.
7.2 What qualifies as a defect
We consider a print defective if any of the following apply:
- A manufacturing error, such as a misprint, misalignment, ink streaking, smudging, or material flaw in the canvas.
- Damage sustained during shipping, such as a torn or punctured canvas, water damage, or a broken stretcher.
- Order fulfillment error, such as receiving the wrong artwork, wrong size, or wrong product.
Slight color variation between your screen and the printed canvas, as described in Section 6, is not a defect.
7.3 How to report a defect
- Contact us at [customer support email] within 14 days of receiving your order.
- Include your order number, a clear description of the issue, and photographic evidence of the defect or damage.
- Do not discard the item or shipping packaging until your claim is resolved.
7.4 Resolution
For valid claims, we will offer one of the following at our discretion: (a) a free replacement print, sent via the same shipping method as the original order; (b) a full refund of the original purchase price; or (c) a partial refund where appropriate. We will pay any return shipping if a return is required.
7.5 Cancellations
Orders are submitted to production immediately upon placement and cannot be cancelled. If you discover an error in your order (incorrect size, wrong shipping address) please contact us at [customer support email] right away — we will do what we can to help, but we cannot guarantee changes once production has begun. Defects and shipping damage are addressed separately in Sections 7.1 through 7.4.
7.6 Refund timing
Refunds are issued to the original payment method used at checkout. After a refund is initiated, please allow 5 to 10 business days for the refund to appear in your account, depending on your bank or card issuer.
8. License Granted to the Buyer
When you purchase a print, you receive a limited, non-exclusive, non-transferable license to display the physical print for personal, non-commercial purposes in a private residence or non-commercial space.
You may not commercially reproduce, distribute, or resell the image as is, in any medium — physical, digital, or print. This includes, without limitation: reprinting the artwork on canvas, paper, fabric, or merchandise; offering digital copies for sale or download; using the artwork in advertising, packaging, or promotional materials; and listing the artwork on any commercial marketplace.
You may resell the physical print as a private, secondary-market transaction (for example, gifting it or selling it to a private collector or friend), provided you do not commercially reproduce the image.
9. Intellectual Property
All content on the Site — including but not limited to written copy, product descriptions, photographs of physical products, page layouts, the “Garipova” name, and brand elements — is owned by us or our licensors and is protected by U.S. copyright and trademark law where applicable.
You may not copy, reproduce, modify, distribute, or use any content from the Site, other than as expressly permitted by these Terms or with our prior written permission.
See Section 2 for the specific copyright status of AI-generated artwork.
10. Your Obligations and Prohibited Uses
- You agree to provide accurate, current, and complete information at checkout, including a valid shipping address.
- You agree not to use the Site for any unlawful purpose, to attempt to disrupt the Site or its underlying systems, or to access any non-public area of the Site.
- You agree not to scrape, harvest, or systematically collect content from the Site, including artwork images, for any commercial or unauthorized purpose.
11. Disclaimers and Limitation of Liability
11.1 Site provided “as is”
The Site and its contents are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, except those that cannot be excluded under applicable law. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
11.2 Product representations
Other than the express warranties set out in Section 7 regarding defective products, we make no other warranties regarding the products. Specifically, we do not warrant that any product will meet your expectations regarding subjective qualities such as artistic taste, color preference, or interior fit.
11.3 Limitation of liability
To the fullest extent permitted by applicable law, our aggregate liability to you for any claim arising out of or relating to the Site, your use of the Site, or your purchase of products is limited to the amount you paid for the product giving rise to the claim. We are not liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to lost profits, loss of data, or loss of business opportunity, even if we have been advised of the possibility of such damages.
11.4 Third-party fulfillment
Production and shipping are performed by our fulfillment partner, Printify, and Printify’s production partners. To the extent any issue arises from the actions or omissions of those third parties, our liability is limited as set out above, and the third parties’ own terms of service may also apply to the production and shipping of your order.
We do not maintain physical inventory.
11.5 No exclusion of mandatory rights
Nothing in these Terms excludes or limits any liability or rights that cannot be excluded or limited under the applicable law of your jurisdiction, including any rights you may have under Connecticut consumer protection statutes.
12. Privacy
Your use of the Site and your purchase of products are governed by our Privacy Policy. The Privacy Policy describes what personal information we collect, how we use it, and with whom we share it (including with our fulfillment partner, Printify, and our payment processors, Stripe and PayPal). Please review the Privacy Policy carefully.
13. Modifications to These Terms
We may modify these Terms from time to time. The current version is always posted on this page, and the “Last updated” date at the top reflects the most recent modification.
If we make material changes, we will provide reasonable advance notice before the changes take effect, by posting a prominent notice on the Site and (where appropriate) by sending an email to the address associated with recent orders.
Your continued use of the Site or placement of new orders after the effective date of a modification constitutes acceptance of the modified Terms. If you do not agree with a modification, please discontinue using the Site. For pending orders not yet in production, you may request cancellation in accordance with Section 7.5.
14. Governing Law and Dispute Resolution
14.1 Governing law
These Terms are governed by and construed in accordance with the laws of the State of Connecticut, without regard to conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
14.2 Venue
Any legal proceeding arising out of or relating to these Terms, the Site, or any product purchase will be brought exclusively in the state or federal courts located in Connecticut. You consent to the personal jurisdiction and venue of those courts.
14.3 Informal resolution first
Before filing a legal claim, please contact us at info@garipova.com and describe the issue. We will make a good-faith effort to resolve the matter informally.
15. General Provisions
15.1 Entire agreement
These Terms, together with the Privacy Policy and any product-specific terms posted on the Site, constitute the entire agreement between you and us regarding the Site and your purchases. They supersede any prior or contemporaneous communications and proposals on the same subject.
15.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it enforceable while preserving the original intent.
15.3 No waiver
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. A waiver of any provision must be in writing and signed by us to be effective.
15.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to a successor in connection with a merger, acquisition, or sale of substantially all of our assets.
